1. Preamble

This website is published by Scintia, a simplified joint stock company (SAS) with capital of €3,000, registered in the Lyon Trade and Companies Register under number 930 581 749, whose registered office is located at 3 rue de Genève, 69006 Lyon, and whose contact address is: contact@scintia.ai. 
The purpose of these General Terms and Conditions of Use (hereinafter referred to as "GTCU") is to define the terms and conditions of access to and use of the www.scintia.ai website (hereinafter referred to as "the Site"), which is freely accessible to any user with an Internet connection. 

2. Object

The purpose of these GCU is to set out the conditions under which visitors may access the Site, consult it and, where applicable, use the form made available (to contact us, request a demonstration, apply for a job, etc.). 
Use of the Site implies full and unconditional acceptance of these GCU. 
Scintia reserves the right to modify them at any time, the version in force being that displayed on the Site on the date of consultation. 

3. Access at website

The Site is accessible free of charge to any user with Internet access, from a computer, smartphone or any other connected terminal. 
Scintia endeavours to provide access to the Site 24 hours a day, 7 days a week, subject to : 
  • Scheduled or urgent maintenance operations; 
  • Force majeure or events beyond its control (cyber-attack, network breakdown, etc.). 
Access to the Site may be suspended, limited or interrupted at any time without notice, in particular for technical, security or updating reasons. 
Scintia cannot be held responsible for any interruption of service, technical failure or any direct or indirect consequence of the impossibility of temporarily accessing the Site. 

4. Property intellectual

All content on the Site - including, but not limited to, text, images, illustrations, videos, logos, graphics, domain names, trademarks and the general architecture of the site - is protected by intellectual property law and belongs exclusively to Scintia or its duly authorised partners. 
Any reproduction, representation, modification, publication, adaptation, transmission or use, in whole or in part, of the Site or its contents, by any process whatsoever and on any medium whatsoever, is prohibited without the prior written permission of Scintia. 
Failure to comply with this prohibition constitutes an infringement of copyright which may give rise to civil and criminal liability on the part of the perpetrator, in accordance with articles L.335-2 et seq. of the French Intellectual Property Code. 

5. Behaviour from users

The user undertakes to use the Site in compliance with the laws and regulations in force and with these GCU. 
It is forbidden to : 
  • Interfere with or disrupt the normal operation of the Site; 
  • Unauthorised access to systems or data; 
  • Use the Site for fraudulent, defamatory or public order purposes; 
  • Transmit illegal, inaccurate or harmful content (viruses, spam, abusive messages, etc.) via the Site's forms. 
Scintia reserves the right to delete any content or form that is manifestly contrary to these rules, or to take any necessary action in the event of abusive or illicit use of the Site. 

6. Liability

Scintia endeavours to provide accurate, up-to-date and accessible information on the Site. However, it cannot guarantee the completeness, accuracy or continuous updating of this information. 
Users acknowledge that they use the Site at their own risk. Scintia cannot be held responsible for: 
  • Any errors or omissions on the Site; 
  • Misuse of the Site by the user; 
  • Any direct or indirect damage resulting from access to or inability to access the Site, including loss of data or time or disruption to browsing. 

7. Links hypertext

The creation of hypertext links to the Site is authorised, subject to : 
  • Clearly identify the origin of the link (Scintia or scintia.ai); 
  • Not to damage the image, reputation or rights of Scintia ; 
  • Not to redirect from a site that is illicit, defamatory or contrary to public order. 
Scintia reserves the right to request the immediate removal of any link that does not comply with these conditions. 
The Site may contain links to other websites. These links are provided for information purposes only. Scintia has no control over their content and accepts no responsibility for the information, products or services offered there. 

8. Data personal

When you visit the scintia.ai website, certain personal data may be collected, in particular via contact forms or audience measurement tools. 
Scintia undertakes to process this data responsibly, securely and in accordance with the regulations in force (in particular the General Data Protection Regulation - GDPR).

 In the event of a dispute relating to the use of the Site or the interpretation of these GCU, and in the absence of an amicable settlement between the parties, the competent courts of Lyon shall have sole jurisdiction, even in the event of multiple defendants or the introduction of third parties.
